Drug Manufacturing Penalties
Those accused of drug manufacturing face stiff penalties. These are based on the nature of the drug and the amount produced. Pennsylvania uses the Federal Government schedule to classify illegal drugs (Schedule I being the most serious, and descending from there).
Penalties for drug manufacturing include:
- Up to 15 years in prison and $250,000 in fines (Schedule I and II drugs)
- Up to 10 years in prison and $100,000 in fines (PCP, Meth, Cocaine, and over 1,000 lbs. of Marijuana specifically)
- Up to 5 years in prison and $15,000 in fines (for Schedule I, II, III drugs not defined in the previous penalty)
- Up to 3 years in prison and $10,000 in fines (Schedule IV drugs)
- Up to one year in jail and $5,000 in fines (Schedule V drugs)
Only the manufacturing Schedule V drugs are considered misdemeanors here, the rest are felonies. Also worth noting is that these felonies come with strict minimum sentences as well, meaning that even if your case might not call for the maximum sentence, you still stand to spend significant time in prison.
